The President has a Right and Duty

The President is elected for a 4yr. term. . He doesn't stop being President at less than 4yrs. The President could nominate a person to fill an empty SC seat on his last day, and it would be legal. It is up to the Senate to either "take it up" and hold hearings, or not. "When" is up to the Majority Leader in the Senate. It is called, " Separation of Powers"
