I recently bought an advertised as Ex Cond rifle from him and payed a premium for it. Now I have a $200.00 repair to McMillan since he would not refund me or cover the repair.

Definitely. A buyer should always be able to return a rifle if they don't believe it was represented correctly. This community operates on trust.

He knew of the problem by the way he presented the pictures in the For Sale Post, You actions are totally justified IMO, That's a shame to see that happen on this site
