I also agree that qualified immunity should be ended.
Sorry but everytime I've been pulled over I never once not had my rights violated.
I worked 2nd shift so I would drive home with a carpool of 3 people at 11:15 pm and get home about 12:20 am. Everyone in the car pool has been pulled over and the very 1st question asked is , where are you going? Where are you coming from? I had the idea of saying to the officer once that "Am I required to answer that question ?" His immediate response is step out of the vehicle and next thing you know its now a vehicle search for drugs for 45 minutes with zero probable cause but for retaliation for asking him a question. The same city police had a officer charged and convicted of falsely arresting multiple people for DUI's so I guess I should be lucky thats all I had happen. If you're asking it was Bountiful city p.d. in Ut im sure you can find it.
And now the American Fork p.d. is under scrutiny for their handling of civil rights in the Lego case thats been in the news.
Its really not the officers fault but the lack of training and the culture inside the police departments that think violations of civil liberty are exceptable as long as they get the so called bad guys. I can't go around violating people's rights with out repercussions and the culture with the police has proven that they cannot control them selves with out the same repercussions. Let them hold insurance for law suits and see how fast civil libertys are respected.
