Montana x-bows illegal

I say, without reservation, keep the lawyers at home. I say that even though my daughter is a lawyer. We are compassionate to handicapped persons. Very few hunters in my life have been without compassion. That being said there are war heros, first responders, and everyday Americans without limbs to even use a crossbow. Some of these folks would give 10 years of their life to go on a hunt. Please respect everyone. Clearly there is an opportunity for you to hunt with crossbow. Be proud you still live in a country and state with that freedom. Very sorry to hear of your disability. I believe if you touted a charity associated with it, on this forum, most members would donate. Hunters and most state wildlife are on the same path. Good hunting

Keep your laws the way they are. Compound bows have done nothing but increase success rates to the point where they will start to cut back tags. Xbows will increase it even farther. I know a lot of guys who hunt with them and have no disability at all. They work the system they are lazy cheaters.

in Montana x-bows are illegal to hunt with during the archery season for everyone . as a handi -cap person with a valid doctor permit for Montana i still am not allowed to use a x-bow during archery season. i did purchase a draw lock system for my compound bow but that is very difficult to carry in the mountains and the draw lock is legal in Montana but its a real joke for a handi -cap person to carry and use. Montana bowhunters association is against people with a disability ,i wonder if that is even legal in America to be against handi-cap people like that ? any attorneys out there ? it might be some easy money ?
The Americans with Disabilities Act (ADA) prohibits discrimination against people with disabilities in several areas, including employment, transportation, public accommodations, communications and access to state and local government' programs and services.
The ADA is divided into five titles:
  • Employment (Title I) ...
  • Public Services (Title II) ...
  • Public Accommodations (Title III) ...
  • Telecommunications (Title IV) ...
  • Miscellaneous (Title V)

I would look into the Americans With Disabilities Act, "ADA.gov" web page, get the necessary forms and file a complaint with them. Your situation might be a bit sketchy; however, I believe that if there's any place where a complaint can be filed it would be here. You will have to do some research and some work on your own, but this is where I would start. I believe that there is a telephone number that can be called to start the process. I dealt with them in the past on another issue, I found the people there to be very knowledgeable and dedicated to helping people.

I live and hunt in Colorado. Out of state hunters paying big bucks for tags make it difficult for me to get good tags. No sympathy here. Stay in your state where your tax dollars support your views and needs.
It's my understanding that only 10% of the tags are allocated for non-residents. Doesn't seem unreasonable to me. This is different discussion though and don't want to hijack the OP.
Hunt when you can with a crossbow in MT or find another state that allows you what you're looking for.

OP. Leave the layers out of it. If you had point stacked up and then became disabled, people may be more sympathetic. There are far better approaches to changing the laws. The laws are there whether you agree or not.

As many have pointed out, there are abuses and these should be dealt with rather than increased legislation. Crossbows are the new compound. Just as in a bygone era, people are ignorant and think this new tool is an easy button and don't comprehend the limitations. Many states have been through this learning curve. Channel your energy into something that can being about a positive change.

This has nothing to do with discrimination.

This is the stupid crap I'm talking about. Self entitled brats running around trying to get free handouts using any loophole in a system they can find. I know veterans with far worse disabilities than the OP that don't take handouts from anyone. They adapt and overcome. One is in a wheel chair missing both his legs and very hard at hearing from the bomb that took his legs. Never hear him complaining about the way things are here.
This nation is turning into a bunch of weak whiners and complainers that scream and cry when they don't get their way because life just isn't fair. Well suck it up buttercup. Somewhere in the world there are always people that have been dealt a hell of a lot worse hand than you.

People should be required to go live in armpits of the Middle East and other degraded 3rd world countries for at least 6 months when they turn 18 so when they come back to America they can actually realize and appreciate how good their life is in the states.

Cry me a river. That's all MT needs is to get the Feds involved, maybe they can determine if a crossbow is a bow and arrow, NOT. A crossbow is not defined as a BOW by MT regs. He should accept the regs as they're are written and hunt with his crossbow when it's allowed. If that's during Muzzleloader or Rifle season then so be it.

Take it or leave it is all I gotta say. If you want to hunt in our state don't complain. Your general tag is good for archery and rifle so if you are not able to hunt with a bow as per our archery laws then wait until rifle season or hunt somewhere else. It's as easy as that.

And threatening us with a lawsuit??? Best of luck with your attorney. You knew the hunting laws when you applied for a tag. The only joke will be you when the Judge throws the case out of court. That is if you can even find an attorney dumb enough to try the case. Do us all a favor and just stay home. You will not be welcome in Montana.
It's people like you that do not deserve to be able able to hunt you have no compassion for anybody or anybody he deserves the hunt just like you or me or anybody else you're the one that should probably stay home

Assuming you live in MT, contact your state agency that deals with ADA issues. They will be able to provide definitive info, and possibly take up your case. If you hunt MT as non-resident, you are a guess and should abide by their rules, and not complain. You should have no input/say. In that case, hunt in your state with X-bow, or another state that permits it for non-residents. If you are a MT resident formerly from CA, trying to change MT laws to your CA loonie ways, then go back to CA. Every win has to start with one RESIDENT person saying, "ENOUGH!!" It's about time some resident American Patriot did same regarding Socialist/Xiden tyrannical directions.
